SongBook Terms of Use (iOS)

These Terms of Use (the "Agreement" or "EULA") govern your use of the SongBook mobile application for iOS ("SongBook" or the "App") published by VinTEK Solutions ("we," "us," or "our"). By downloading, installing, or using SongBook, you agree to be bound by this Agreement. If you do not agree, do not use the App.

This Agreement is between you and VinTEK Solutions only, and not with Apple Inc. ("Apple"). VinTEK Solutions, not Apple, is solely responsible for SongBook and its content. Apple is a third-party beneficiary of this Agreement and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce it against you.

1. License Grant

Subject to your compliance with this Agreement, VinTEK Solutions grants you a limited, non-transferable, non-exclusive, revocable license to download and use SongBook on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules in effect at the time. The license is personal to you and may not be shared, rented, leased, sold, redistributed, or sublicensed.

2. Subscriptions and In-App Purchases

Available Subscriptions

SongBook offers the following auto-renewable subscriptions through Apple's In-App Purchase system:

Pricing in your local currency may vary based on your App Store region and applicable taxes. Current pricing is always displayed in the App before you confirm purchase.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period.

How to Manage or Cancel

You can manage and cancel your subscriptions at any time through Settings → [your name] → Subscriptions, or via the App Store app. Cancellation takes effect at the end of the current billing period; you will continue to have access to Plus or Pro features until that point. Deleting SongBook from your device does not cancel your subscription.

Refunds

Payments are processed by Apple. Refunds are governed by Apple's Media Services Terms and Conditions. To request a refund, visit reportaproblem.apple.com.

Free Trials

If a free trial is offered, it is available only to first-time subscribers. The trial converts to a paid subscription automatically at the end of the trial period unless cancelled at least 24 hours beforehand.

3. User-Generated Content (Songs, Setlists, Notes)

SongBook stores songs, chord charts, setlists, lyrics, notes, and exports that you create or import. You retain ownership of content you create. You represent that you have the right to use any lyrics, chords, or other content you import or upload, and that doing so does not infringe any third party's intellectual property or other rights. SongBook is a tool for your personal/professional songbook organization; you are responsible for any licensing or royalty obligations associated with the songs you store, perform, or distribute.

4. Use of SongBook

You agree to use SongBook only for lawful purposes and in accordance with this Agreement. You agree not to:

5. Account and Data

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may delete your account and all associated data through the App or by emailing us at vintek615@gmail.com. Our handling of your data is described in the SongBook Privacy Policy, which is incorporated into this Agreement by reference.

6. Maintenance and Support

VinTEK Solutions is solely responsible for providing any maintenance and support for SongBook, as required by applicable law. Apple has no obligation to provide any maintenance or support services. Contact us at vintek615@gmail.com.

7. Warranty Disclaimer

SongBook is provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law.

In the event of any failure of SongBook to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to SongBook. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of VinTEK Solutions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will VinTEK Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of SongBook. Our total cumulative liability to you for any claim arising from this Agreement will not exceed the amount you paid us, if any, in the twelve months prior to the event giving rise to the claim.

9. Product Claims

VinTEK Solutions, not Apple, is responsible for addressing any claims by you or any third party relating to SongBook or your possession and use of SongBook, including, but not limited to: (i) product liability claims; (ii) any claim that SongBook fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Intellectual Property

SongBook and all related code, features, and trademarks are owned by VinTEK Solutions or its licensors. In the event of any third-party claim that SongBook itself (excluding your user-generated content) infringes that third party's intellectual property rights, VinTEK Solutions, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

11. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

12. Termination

We may suspend or terminate your access to SongBook if you breach this Agreement. You may terminate by deleting your account and removing the App.

13. Changes to These Terms

We may update this Agreement from time to time. The "Last updated" date will reflect the latest revision. Continued use after changes constitutes acceptance of the updated Agreement.

14. Governing Law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict-of-law principles, except where prohibited by your local law. Disputes will be resolved in the state or federal courts located in California, except where prohibited by your local law.
