ASVAB Prep Terms of Use (iOS)

These Terms of Use (the "Agreement" or "EULA") govern your use of the ASVAB Prep mobile application for iOS ("ASVAB Prep" or the "App") published by VinTEK Solutions ("we," "us," or "our"). By downloading, installing, or using ASVAB Prep, you agree to be bound by this Agreement. If you do not agree, do not use the App.

This Agreement is between you and VinTEK Solutions only, and not with Apple Inc. ("Apple"). VinTEK Solutions, not Apple, is solely responsible for ASVAB Prep and its content. Apple is a third-party beneficiary of this Agreement and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce it against you.

ASVAB Prep is an independent test-prep tool. ASVAB Prep is not affiliated with, endorsed by, sponsored by, or otherwise approved by the United States Department of Defense, any branch of the U.S. Armed Forces, the ASVAB program, or the developers of the ASVAB exam. "ASVAB" is a registered trademark of its respective owner; we use the term descriptively to identify the test our content prepares users for.

1. License Grant

Subject to your compliance with this Agreement, VinTEK Solutions grants you a limited, non-transferable, non-exclusive, revocable license to download and use ASVAB Prep on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules in effect at the time. The license is personal to you and may not be shared, rented, leased, sold, redistributed, or sublicensed.

2. Subscriptions and In-App Purchases

Available Products

ASVAB Prep offers the following purchases through Apple's In-App Purchase system:

Pricing in your local currency may vary based on your App Store region and applicable taxes. Current pricing is always displayed in the App before you confirm purchase.

Auto-Renewal (Pro Monthly Only)

The Pro Monthly subscription automatically renews at the end of each month at the then-current price unless you cancel at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period.

The 3-month and 6-month Prep Packs are non-renewing. Access ends automatically when the period expires; you will need to make a new purchase to continue.

How to Manage or Cancel

You can manage and cancel the Pro Monthly subscription at any time through Settings → [your name] → Subscriptions, or via the App Store app. Cancellation takes effect at the end of the current billing period. Deleting ASVAB Prep from your device does not cancel your subscription.

Refunds

Payments are processed by Apple. Refunds are governed by Apple's Media Services Terms and Conditions. To request a refund, visit reportaproblem.apple.com.

Free Trials

If a free trial is offered, it is available only to first-time subscribers. The trial converts to a paid subscription automatically at the end of the trial period unless cancelled at least 24 hours beforehand.

3. Educational Content Disclaimer

ASVAB Prep provides practice questions, lessons, flashcards, and AI-generated explanations to help you prepare for the ASVAB. We do not guarantee any specific score, AFQT result, military qualification, or job placement. Practice content is not the official ASVAB and may differ from the questions you encounter on the actual exam. Use ASVAB Prep as one of many study resources.

AI tutor explanations are generated by large language models and may contain errors. Always cross-check critical concepts with official study materials.

4. Use of ASVAB Prep

You agree to use ASVAB Prep only for lawful, personal, non-commercial study purposes. You agree not to:

5. Account and Data

ASVAB Prep supports anonymous use; you may optionally link a Google or Apple account for cloud backup. You are responsible for maintaining the confidentiality of any linked account. You may delete your account and all associated data through the App or by emailing us at vintek615@gmail.com. Our handling of your data is described in the ASVAB Prep Privacy Policy, which is incorporated into this Agreement by reference.

6. Maintenance and Support

VinTEK Solutions is solely responsible for providing any maintenance and support for ASVAB Prep, as required by applicable law. Apple has no obligation to provide any maintenance or support services. Contact us at vintek615@gmail.com.

7. Warranty Disclaimer

ASVAB Prep is provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law.

In the event of any failure of ASVAB Prep to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to ASVAB Prep. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of VinTEK Solutions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will VinTEK Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of ASVAB Prep — including, without limitation, any decision you make based on practice scores, AI-generated explanations, or job-score estimates. Our total cumulative liability to you for any claim arising from this Agreement will not exceed the amount you paid us, if any, in the twelve months prior to the event giving rise to the claim.

9. Product Claims

VinTEK Solutions, not Apple, is responsible for addressing any claims by you or any third party relating to ASVAB Prep or your possession and use of ASVAB Prep, including, but not limited to: (i) product liability claims; (ii) any claim that ASVAB Prep fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Intellectual Property

ASVAB Prep and all related code, content (questions, lessons, flashcards, illustrations), features, and trademarks are owned by VinTEK Solutions or its licensors. In the event of any third-party claim that ASVAB Prep or your possession and use of ASVAB Prep infringes that third party's intellectual property rights, VinTEK Solutions, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

11. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

12. Termination

We may suspend or terminate your access to ASVAB Prep if you breach this Agreement. You may terminate by deleting your account and removing the App.

13. Changes to These Terms

We may update this Agreement from time to time. The "Last updated" date will reflect the latest revision. Continued use after changes constitutes acceptance of the updated Agreement.

14. Governing Law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict-of-law principles, except where prohibited by your local law. Disputes will be resolved in the state or federal courts located in California, except where prohibited by your local law.
