Smoke Chamber Terms of Use (iOS)

These Terms of Use (the "Agreement" or "EULA") govern your use of the Smoke Chamber mobile application for iOS ("Smoke Chamber" or the "App") published by VinTEK Solutions ("we," "us," or "our"). By downloading, installing, or using Smoke Chamber, you agree to be bound by this Agreement. If you do not agree, do not use the App.

This Agreement is between you and VinTEK Solutions only, and not with Apple Inc. ("Apple"). VinTEK Solutions, not Apple, is solely responsible for Smoke Chamber and its content. Apple is a third-party beneficiary of this Agreement and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce it against you.

Food Safety Notice

Smoke Chamber provides barbecue and smoking recipes, cook timelines, and optional Bluetooth thermometer readings. The App is a planning and reference tool, not a food-safety device. You are solely responsible for cooking all food to safe internal temperatures as recommended by your local food-safety authority (for example, the USDA), and for verifying those temperatures with a reliable, independently calibrated thermometer. Times, temperatures, and probe readings shown in the App are estimates and may be inaccurate. Do not rely on the App alone to determine whether food is safe to eat.

1. License Grant

Subject to your compliance with this Agreement, VinTEK Solutions grants you a limited, non-transferable, non-exclusive, revocable license to download and use Smoke Chamber on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules in effect at the time. The license is personal to you and may not be shared, rented, leased, sold, redistributed, or sublicensed.

2. Subscriptions and In-App Purchases

Smoke Chamber offers the following purchases through Apple's In-App Purchase system:

Pricing in your local currency may vary based on your App Store region and applicable taxes. Current pricing is always displayed in the App before you confirm purchase.

Auto-Renewal (Monthly & Annual Only)

Monthly and Annual Pro subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period. The Lifetime purchase is a one-time charge with no renewal.

How to Manage or Cancel

You can manage and cancel auto-renewing subscriptions at any time through Settings → [your name] → Subscriptions, or via the App Store app. Cancellation takes effect at the end of the current billing period. Deleting Smoke Chamber from your device does not cancel your subscription.

Refunds

Payments are processed by Apple. Refunds are governed by Apple's Media Services Terms and Conditions. To request a refund, visit reportaproblem.apple.com.

Free Trials

If a free trial is offered, it is available only to first-time subscribers. The trial converts to a paid subscription automatically at the end of the trial period unless cancelled at least 24 hours beforehand.

3. Recipe and AI Disclaimer

Smoke Chamber's recipes, AI-generated ingredient substitutions, and AI custom-cook generator produce suggestions for personal preparation. You are solely responsible for verifying ingredient compatibility, allergens, food safety, and safe internal cooking temperatures for any food you prepare. AI suggestions are not professional culinary, dietetic, or medical advice. We make no representation that any AI-generated recipe is safe, palatable, or suitable for your circumstances.

4. Bluetooth Thermometers

Smoke Chamber can optionally connect to certain third-party Bluetooth (BLE) thermometers to display temperature readings. We are not affiliated with thermometer manufacturers, and we do not warrant the accuracy, calibration, connectivity, or fitness of any third-party device. Readings shown in the App may lag, drop, or be incorrect. Always confirm doneness with a reliable, independently verified thermometer.

5. Use of Smoke Chamber

You agree to use Smoke Chamber only for lawful purposes and in accordance with this Agreement. You agree not to:

6. Account and Data

Smoke Chamber supports anonymous use; you may optionally link an account for cloud backup of your cooks, journal, and favorites. You are responsible for maintaining the confidentiality of any linked account. You may permanently delete your account and all associated data at any time from within the App (Profile → Delete account), or by emailing us at vintek615@gmail.com. Our handling of your data is described in the Smoke Chamber Privacy Policy.

7. Maintenance and Support

VinTEK Solutions is solely responsible for providing any maintenance and support for Smoke Chamber, as required by applicable law. Apple has no obligation to provide any maintenance or support services. Contact us at vintek615@gmail.com.

8. Warranty Disclaimer

Smoke Chamber is provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law.

In the event of any failure of Smoke Chamber to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Smoke Chamber. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of VinTEK Solutions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will VinTEK Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of Smoke Chamber — including, without limitation, any harm associated with the preparation or consumption of food following the App's recipes, timelines, or AI suggestions, or reliance on any temperature reading. Our total cumulative liability to you for any claim arising from this Agreement will not exceed the amount you paid us, if any, in the twelve months prior to the event giving rise to the claim.

10. Product Claims

VinTEK Solutions, not Apple, is responsible for addressing any claims by you or any third party relating to Smoke Chamber or your possession and use of Smoke Chamber, including, but not limited to: (i) product liability claims; (ii) any claim that Smoke Chamber fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11. Intellectual Property

Smoke Chamber and all related code, content (recipes, illustrations, photography), features, and trademarks are owned by VinTEK Solutions or its licensors. In the event of any third-party claim that Smoke Chamber or your possession and use of Smoke Chamber infringes that third party's intellectual property rights, VinTEK Solutions, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

12. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

13. Termination

We may suspend or terminate your access to Smoke Chamber if you breach this Agreement. You may terminate by deleting your account and removing the App.

14. Changes to These Terms

We may update this Agreement from time to time. The "Last updated" date will reflect the latest revision. Continued use after changes constitutes acceptance of the updated Agreement.

15. Governing Law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict-of-law principles, except where prohibited by your local law. Disputes will be resolved in the state or federal courts located in California, except where prohibited by your local law.
